Mayor Foster Asked to Challenge President Obama’s Panel to Kill and Capture Americans Without A Trial.

Today, as a citizen of St. Petersburg, I asked that Mayor Bill Foster demand that President Obama reveal every operational detail of a panel he has created under the National Security Council to assemble a “Kill and Capture” list of American Citizens.  On Thursday (10/5/11), Reuters news reported that such a panel existed and indicated that it operates outside of the law and constitution of the united states which requires that all citizens be afforded due process before being deprived of their “life, liberty or property”.  Jake Tapper of ABC News is not getting any answers from the white House on this issue and it is going to take legal action to  get any answers and stop this unconstitutional and immoral activity. The letter to the Mayor asks him to take legal action to stop this unconstitutional action.  This panel was used to justify the assassination of American Citizen Anwar Alwaki last week for what basically amounted to a case of guilt by association and free speech (preaching hate in an Islamic Mosque).  It is easy to hate the despicable Anwar Awlaki, but one should fear the environment we are creating when we remember the line in the poem “Then they came for the Jews, and I was not a Jew so I did not speak up… Then they came for me, and there was no one left to speak for me”.  Reuters reported as follows:

“Some details about how the administration went about targeting Awlaki emerged on Tuesday when the top Democrat on the House Intelligence Committee, Representative Dutch Ruppersberger, was asked by reporters about the killing.

The process involves “going through the National Security Council, then it eventually goes to the president, but the National Security Council does the investigation, they have lawyers, they review, they look at the situation, you have input from the military, and also, we make sure that we follow international law,” Ruppersberger said.

In other words American citizens are being killed solely on the actions of one branch of government that is not constitutionally authorized to determine if that person is guilty.  The person has no lawyer, no due process and no appeal.  This is truly the rule of man overcoming the rule of law and a complete rejection of our American system of Justice.

One wonders if anyone in St. Petersburg either at home or travelling abroad is being considered for inclusion on the “Kill and Capture list”.  Will residents of St. Petersburg be assassinated in their homes merely for being listed by a shadowy secret agency as a “danger” to society?  I discussed this issue in the May 2010 article “Loss of American Citizenship and Assassinations”.

Mayor Bill Foster,

As a citizen of St. Petersburg, I am asking that the City formally request that the President of the United States publically reveal all details relating to the operations of a National Security Council panel that is assembling a kill and capture list of American Citizens.  I am asking you, on behalf of the citizens of St. Petersburg, to demand that the President ensure full due process for any American citizen who is being considered for execution or deprivation of their liberty using all the current standards of American Jurisprudence.  The letter to the President that you sign should indicate that you oppose any effort to imprison or summarily execute American Citizens anywhere in the world without the rights they are afforded under our Constitution’s Fifth Amendment.

Amendment 5

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

My request is in response to a story by Reuter’s News (10/5/11) that the President has assembled such a panel under the National Security Council.  It is my opinion that the law allows you, as a representative of our municipal group of citizens, to make such a request of the President.  It is also within the purview of the City of St. Petersburg to take Legal action, alone or in a coalition with other representative bodies, to prevent such unconstitutional action by the Federal Government.

Our country was founded as a place where rule of law, equal justice and due process prevail. This action by the President of the United States creates a system where rule of man prevails and justice and due process is denied leading us closer to a dictatorship.
