Story of the Week – Supreme Court Malfeasance: Editor’s note. The Sunbeam Times continues its series later today on the founding principles of our country and how they are under assault (Today: Free Markets/Property Right, Tomorrow “Equal Justice/Rule of Law”).   The recent Supreme Court Rulings on Obamacare, Government defined marriage and on disparate racial outcomes of housing have ignored standard jurisprudence. The decisions were based on political desires of the Justices and not on sound legal precedence, the laws themselves or the Constitution. These are an example of “Rule of man” versus what free societies are based on: “Rule of Law”.

How Republics Die “But too many people.. think that the purpose of the Supreme Court is to give them things they like, like subsidies for health care, or the right to marry someone of the same sex. They care only about the results, and are indifferent to the process But the means matter. If.. ambiguous laws can be changed by judges per their divination of legislative intent, then there is no law except what the judges think it is… When we ignore/side step the Constitutional and legal process to achieve a desired end, the bedrock starts to turn to sand. When the laws are ignored by those who have sworn to uphold, the rule of law itself disintegrates. When the public doesn’t care.., but votes anyway for people who tell them they’ll just give them stuff they like, that is how republics are lost.”

Study: Electric Cars Worse For Environment Than Gas Powered Cars “A study published by the National Bureau of Economic Research found that .. electric cars were on average worse for the environment when compared to their gas-run counterparts…The environmental effects of the different vehicles depended largely on where they were driven. In urban areas, electric vehicles performed better, while the opposite occurred once the cars left the city. In Grand Forks. electric vehicles were 3 cents worse f per mile, while in Los Angeles, they performed 3.3 cents better per mile.The authors believe that this is an important distinction, especially when taking into account the federal government pays a $7,500 subsidy for every electric car purchased…They believe that a per mile tax of vehicles would be a much more efficient approach to curbing carbon emissions, then the current government approach.”

Supreme Court rules against EPA on pollution rules A decision that finally makes sense!! “The Supreme Court ruled 5-4 against EPA pollution rules for power plants.. The majority decision, written by Justice Scalia, said the EPA has to consider the costs of complying with the rules and sent the air pollution regulations back to the agency. The EPA rules in question regulate hazardous air pollutants and mercury from coal- and oil-fired power plants, known as the MATS regulations. The utility industry had argued that the rules cost them billions to comply and that EPA ignored the cost issue in putting the regulations into effect. “EPA must consider cost including cost of compliance before deciding whether regulation is appropriate and necessary.. The decision will have repercussions for other EPA regulations that are key to Obama’s climate change agenda.”

22 states sue EPA over water rule West Virginia with other states argue that the EPA “rules undermine the constitutional rights of states to manage their own waterways. West Virginia Attorney General Morrisey called the rules “regulatory lunacy. “The regulations extend the EPA’s regulatory reach over what is termed “navigable waters,” which ranchers, farmers and states argue gives the federal agencies’ unprecedented authority over drainage ditches and nearly anything else that can contain water. “This rule is a staggering overreach by the federal government.. “It will have dire consequences for homeowners, farmers and other entities by forcing them to navigate a complex federal bureaucracy and obtain costly permits in order to perform everyday tasks like digging ditches, building fences or spraying fertilizers.”

Voting Rights Advocates Get Win at Supreme Court “Arizona citizens can continue to participate in voter registration drives without worrying about not having proof of citizenship documents,” Shirley Sandelands, of the League of Women Voters of Arizona, said in a statement Monday. Both Kansas and Arizona have state laws that require applicants to prove their citizenship when applying to vote with state forms (for state or federal elections). But the U.S. EAC denied the states’ requests to have their citizenship laws applied when would-be voters use the standardized federal form..Kobach said he’ll be sending another request to the EAC, but that that request will be presented differently from the state’s previously denied request…“Every time an alien votes, it may not steal an election, but it will cancel out a vote of a U.S. citizen,” Kobach said.

Puerto Rico governor calls for bankruptcy; adviser says island ‘insolvent’ Looks like Puerto Rico is in dire straits with a debt of 78 billion dollars. “Puerto Rico “urgently needs our help,” Rhodes said. “It can no longer pay its debts, it will soon run out of cash to operate, its residents and businesses will suffer,” he added. Puerto Rico is not eligible for debt restructuring under the U.S. bankruptcy code because it is not a municipality. Rhodes said the island’s future hinges on gaining eligibility for debt restructuring, while stressing that bankruptcy would not be a “bailout. Garcia Padilla also said that citizens may face cuts in services as the government reduces spending. “The situation is dire, and I mean really dire,” said former IMF economist Anne Krueger, co-author of the report commissioned by the U.S. territory, which recommended debt restructuring, tax hikes and spending cuts. ”

Lawmakers triple funding for special-needs scholarships “A statewide scholarship program for special-needs children will now serve three times as many students because of a boost in funding from the state Legislature this session. Florida lawmakers tripled the money allocated for the second year of the personal learning scholarship account program, from $18.4 million to $53.4 million. That’s enough to provide scholarship accounts to more than 5,000 students during the coming school year. In its first year, 1,700 students with disabilities were granted accounts, including 95 in Hillsborough County, 53 in Pasco and 78 in Pinellas.”
